PRINCIPAL elders of Ayikai Doblo community in Ga West Municipality under the Akumajay Divisional Council of the Greater Accra Region have denied allegations of fraudulently selling seventeen (17) plots of land belonging to Nii Adama Pataku Family of Abanman, near Amasaman to the Municipal Chief Executive (MCE) for Ga West Municipal Assembly, Mr Clement Wilkinson Odartey Lamptey to build houses for the lawyers.
Consequently, the elders further refuted falsehood peddling by Alhaji Shorwumi Abdullah Williams and James Laryea Ashia to the effect that the principal Caretaker of Ayikai Doblo Stool Land, Nii Amoo Dodoo Amu aka T.J Azonto is a notorious landguards who is on police wanted list at the Property Fraud Unit in Accra.
They also described as completely false allegations by Mr Williams and Mr James Laryey Ashia that the MCE has employed the services of notorious landguards with the support by the young men of Ayikai Doblo to terrorize land owners and to forcefully and illegally take the land from the real land owners under the MCE jurisdiction..
The elders of Ayikai Doblo Stool lands made these foregoing clarification in the reaction to the media publication being carried by Sharpnewsgh.com on Monday June 15, 2020 with the screaming headline “Ga West Cited In Fraudulent Land Grabbing in Abanman,” which was attributed to Alhaji Shorwumi Abdullah Williams and Mr James Laryea Ashia as the sources of the said publication.
In that report, the online news portal noted that the MCE has employed the services of Landguards to terrorize Land owners and to forcefully and illegally take their land from the real land owners under his jurisdiction.
In recent time, the report stated that the MCE has fraudulently acquired and graded about 17 plots of land belonging to Nii Adama Pataku Family of Abanman, through one Nii Amoo Dodoo Azonto a notorious landguards who is on Police wanted list at the Property Fraud Unit.
The report indicated that “His capacity as MCE for Ga West is questionable because of his involvement in supporting Landguards activities under his jurisdiction. It was in this spirit the Head of Adama Pataku Family wrote to him Through the family lawyer to warn him to stay away but to no avail.”
The report asserted landguards led by Nii Amoo Dodoo has threatened the family not to step foot on the family land or else they will meet their untimely death.
On May 9th this year, the notorious Landguard aided by the MCE unleashed Landguards at Abanman and caused physical injuries to one Mr. Ashia Laryea who has the power of Attorney to oversee the administration of Land at Abanman when he went on site visit.
Several reports have been made to the AMASAMAN district and divisional police but no action has been taken because of the influence of the MCE.
The family is therefore seeking the assistance of government and security agencies to call the MCE to order and also investigate the activities of Landguards led by Nii Amoo Dodoo at Abanman and it’s environs.
It has become necceary to call on the authorities to intervene in this rather volatile matter after several caution has been thrown tontue MCE for Ga West to stop dealing with the landguard Nii Amoo Dodoo has fallen on death ears.He has also blatantly disregarded warnings from the family Lawyer to him and still dealing with the landguard to terrorize thebreal ownwers of the land, twist their hand and take their land from them.
It’s trite knowledge that Clement Wilkinson Odartey Lamptey knew the real owners of the land and had dealt with them in the past. Question is, what has changed? Is it because his party New Patriotic Party (NPP) has come to power and has been elevated MCE for the area? Was he appointed MCE to team up with landguards to terrorize and zeise People’s Lands? We need answers to these nagging questions.
But in a sharp respond the elders of Ayikai Doblo Stool land flatly denied allegations leveled against them and the Ga West MCE, saying that although the MCE approached the principal Caretaker of Ayikai Doblo Stool lands, Nii Dodoo Amu aka T.J Azonto to sell land to the Assembly to build houses for lawyers, they didn’t sold the said land to him as claimed by Alhaji Shorwumi Abdullah Williams and James Laryea Ashia in their recent media publication.
According to them, they taken legal action in Accra High Land Division against Alhaji Shorwumi Abdullah Williams and other persons who are trespassing on the said land adding that the recent publication of the two was a sinister plot to throw dust onto the faces of Ghanaians to give the two the changes to unlawfully continue to sell the said stretch of the land to the unsuspecting Ghanaians land developers.
They indicated that Nii Doodo Amu has been given power of attorney by Akumanjen Stool headed by Nii Ayikai III, together with his elders to represent the Akumajen Stool in all matters relating to lands transaction of Ga Mashie and that the assertions by Alhaji Shorwumi Williams and James Laryea Ashia that Nii Doodo Amu aka T.J Azonto is a land-guard are untrue, saying that “Nii Doodo Amu is not a land-guard and canot be a land-guard.”
They stated categorically that there is no area in the traditional and historical maps and records in the Ga State and the Lands Commission of Ghana that is known as the Abamma or Bama community situated in the Ga West Municipality.
In the real fact, the elders explained that the long standing claims by some elders of the Nii Adama Pataku family by deceiving general public to the effect that there is a place called Abamma community near Ayikai Doblo for which they are the allodia or custodian owners of that stretch of the land were factually inaccurate and misleading.
They noted that one Alhaji Shorwumi Abdullah Williams, an Accra based Nigerian and self-styled caretaker of Adama Pataku family land and Mr James Laryea Ashia have jointly connived and succeeded in creating such name (Abamma) to the said area which was previously leased for farming in the colonial days by the elders of Ayikai Doblo Stool who are the custodian owners of the said land.
The development, the elders stated has given full advantage to the two to indiscriminately and legally selling the said land which belonging to the Ayikai Doblo Stool to some unsuspecting Ghanaians without recourse to the policies and laws that are regulating the sale of the lands in the area.
According to the elders, the said area are all under the Ayikai Doblo Stool lands within the region of 22,082 acres, which involves the surrounding villages like Nsakinaa, Obeyie and Oyansana just to mention a few of them.
They explained that there was a judgement by the Accra High Court of Justice in Financial Division One on the said land which the court presided over by Lordship, Justice P. Bright Mensah ruled in favour of Akumajay Stool on behalf of the Ayikai Doblo Stool in the case suit No IRI38/2009 dated on Tuesday July 13,2020 versus the Paramount Chief of Akamajay Traditional Area, Nii Ayika III and Mr J.L Ampah Sampong who the was leased to him for farming.
The court judgment which was intercepted by this reporter reads in part ” In his amended writ of summons Nii Ayika III (the plaintiff) is seeking a declaration that the lease dated 9/10/68 made between Mr J.L Ampah Sampong (defendant) and Akanmajey Stool in respect of the percel of the land described in the writ has lapsed of effluxion by time.
Additionally, the judgment noted that “the plaintiff seeks for an order that the Lands Commission in Accra shall delete from its records forthwith, that lease herein before referred to.”
The court judgment stated that “l have critically considered the evidence offered by Nii Ayika III, the plaintiff herein and l hold that he has satisfied the court that he is entitled to his claims. Indeed there is overwhelming evidence that the lease contract was executed on 9/10/69 which was to subsist for 30 years. With effluxion of the time, the lease became spent force in October 1999.
“I hereby enter judgment for the plaintiff for claims as endorsed on the writ except relief (c) which is struck out as abandoned.
“I hereby made an order that the Lands Commission shall delete forthwith from its records, conveyance/ lease dated 9/10/68 executed between Plaintiff’s Predecessor Nii Abossey Okai lll and Mr J.l.A. Sarpong,” His Lordship Justice P. Bright Mensah declared in his judgement.
Having seen the particulars in the case brought before him, Lordship, Justice P. Bright Mensah has awarded costs of GHC 2000 in favour of the plaintiff.
“So where are continuous claimes by these self seeking elders of the Adama Pataku family that they were still the custodian owners of the said land at Ayikai Doblo community. We want to state that Mr J.l.A. Sarpong has registered the said land in the Lands Commission ostensibly to guarantee his farm products before farming on it but the Paramountcy took it from him back by the court judgement,” the elders stated.
The elders of Ayikai Doblo Stool who showed series of documentary proofs to back their claims that indeed they are custodian owners of the said land clarified that the power of attorney was given by the Akumajay Divisional Council and endorsed and certified by the Ga Traditional Council and Lands Commission of Ghana to Nii Doodo Amu aka T.J Azonto to take general control over the swathes of lands at Ayikai Doblo including the area under the borne of contention.
In a addition,they pointed out that the late Adama Pataku was just farming on the land in the colonial days, saying since he was given the chance by the elders of Ayikai Doblo Stool to do so it does not meant that the land is the bonafide property of Adama Pataku as being claimed by some elders of the Adama Pataku family.
They stated that all official records at the Lands Commission and Akumajay Divisional Council aclearly points to only one irresistible fact that the said land belongs to the Ayikai Doblo Stool under the Akumajen Divisional Stool.
They noted that the power of Attorney so granted to Mr James Laryea by the self-styled head of the Adama Pataku family, Alhaji Shorwomi Abdullah Williams to take control over the said land was actuated by fraud and malice.
“We have been informed that Alhaji Abdullah Shorwumi Williams has given the power of attorney to Mr James Laryea Ashia to be going to the police station to represent him in the certain case at the then time when he (Alhaji Shorwumi Abdullah Williams) has a problem with his eyes and couldn’t be able to go to the police station to pursue the case. And so that power of attorney granted to Mr James Laryea Ashia have nothing to do with the land transactions on the Ayikai Doblo Stool lands,” the elders stressed.
They contended that Alhaji Shorwomi Abdullah Williams is not a recognized head of Adama Pataku family and do not also have capacity to grant power of attorney to Mr James Laryea and that the only recognized head of Adama Pataku family is Nii Adama Pataku aka Nii Ayi Fire.
They indicated that Alhaji Shorwumi Abdullah Williams is a Nigerian by tribe, noting that in Ga culture and tradition “we indeed inherit properties from out father lineage and not mother lineage,” even the claims of Alhaji Shorwumi Abdullah Williams that his mother is a Ghanaian from Adama Pataku farmily at Ayikai Doblo is a very long family which has nothing to do with land transactions in the area.”
“We dare Alhaji Shorwumi Abdullah Williams to come and show where is the Adama Pataku family house in Ayikai Doblo and even who made him a substantive head of Adama Pataku family and which customarily rites were they performed to select him as the head of Adama Pataku family,” Nii Doodo Amu thrown the challenge.
Speaking in an interview with this reporter, Nii Doodo Amu stated that Alhaji Shorwumi Abdullah Williams does not have traditional capacity to give power of Attorney to Mr James Laryea Ashia to overlord the said stretch of the land since he does hails from the Ayikai Doblo.
He cautioned the public that the manufacturing, procuring or donating of such power of attorney to the said James Laryea Ashia is a scheme put up to dupe them, since all official records at the Lands Commission clearly points to only one irresistible fact that the said land belongs to the Ayikai Doblo Stool and not family lands.
Nii Doodo Amu minced words when he refuted allegations leveled against him to the effect that he bought motor bikes to some young men who are landguards at Ayikai Doblo to terrorize and visit mayhem at lands developers who bought lands from James Laryea Ashia and his followers.
But in a riposte, Mr James Laryea Ashia resisted that the elders of the Nii Adama Pataku family were the custodian owners of Abamma lands in Accra, saying that the claims by Nii Doodo Amu and his elders that there is no place called Abamma was completely false.
They stressed that if the elders claimed that the lands at Abamman were not the bonafide property of the Adama Pataku family then they should to court.
They repeated their early warning to individuals land developers and organizations who bought the percels of land from the group of people who are not recognised members of the Adama Pataku family should ceased developing the land in order to not loss their properties.
